To publish a text by any means generally requires a legal registration: the Copyright in the USA, and in France the «dépôt légal» (legal deposit) which is even mandatory, at the «Bibliothèque Nationale» (National Library, http://www.bnf.fr ), at the home ministry and at a local public library.

When I came to publish my novels of the Eolis on this site, I thus normally made the legal deposit. It worked perfectly well with the home ministry and public library, but from the National Library came an odd answer, stating that, among various high flown arguing, that publishing on the net cannot be registered, as it was not a publishing, but a «resource available on line»!

Of course mails to the National Library and to the culture ministry (which rules the National Library) were not answered.

This arise special concerns, as publishing on the net is a common affair and a flourishing business, undertaken now by thousand of peoples anc companies in fields as literracy, news, games, software, databases... and the only answer of French administration is to block it!

Why? I really not see the stake.

In other countries, especially in USA, the copyright of net published documents in a common affair, and procedures were enforced from the simple authority of the Library of Congress. Various thinking works are undertaken to solve the problems involved. (unstable documents, absence of a material object to define a document...) I normally copyright registered my book «General Epistemology», except that the receipt comes after several months.

Solution: I was however able to made the French legal deposit of more recents documents on this site, but without indicating it is on internet, and while adding a disquette of it. It is now registered, but under the category «document multimédia»...

The Bibliothèque Nationale is now undertaking a great project of «memory of the net». Good, but only if it is objective and if it allows for a real protection, opposable in law.
